Users residing outside of Spain:
In no case does Atani proactively and systematically inform the Tax Authorities or other public entities about the activity of its users, nor do these entities have access to user data.
Atani only informs authorities in the case of an explicit request, and exclusively for the Atani Exchange service. This practice is standard and mandatory for any investment platform registered to operate legally.
If the account aggregation service (or any other service that leverages connected third-party accounts) is used, Atani cannot, under any circumstances, inform any authority, as it is a non-custodial service for which the identity verification process is not required.
Users residing in Spain:
Starting from January 1, 2024, all entities residing or having a permanent establishment in Spain that allow cryptocurrency operations or provide maintenance and storage services for virtual currencies, as is the case with Atani Exchange, are obligated to report to the Tax Authorities on the balances and operations carried out by their users residing in Spain.
This obligation applies to all Exchanges, Brokers, and other cryptocurrency providers operating legally in Spain (including Binance, Bit2me, etc.).
